General terms and conditions of subtel GmbH

 

1. Area of validity and provider

 

1.1. These General Terms and Conditions apply to all orders, in particular those issued by the end user in accordance with § 13 BGB towards the company subtel GmbH, Mainzer Strasse 3, 10247 Berlin, Germany (hereinafter "subtel GmbH").

 

1.2. A purchase agreement is concluded on the website www.subtel.nl, by the order confirmation from subtel GmbH and at the latest by the unconditional receipt of the goods by the customer. The product displays in the online shop serve to issue an offer of purchase. You are making a binding offer of purchase when you have followed the online ordering process, entered the requested personal data and clicked on "send order" at the last step in the ordering process. You will receive the order confirmation by e-mail immediately after sending the order. This concludes the purchase agreement. If our order confirmation contains spelling or printing errors or if the calculation of the purchase price contains errors due to technical problems, we are entitled to challenge the contract, whereby we must prove our mistake. In this case, any payments already made will be refunded immediately.

2.1. Right of withdrawal

You may revoke the concluded sales contract within 14 days without giving reasons. This revocation can take place in text form (letter, fax or e-mail) or by returning the purchased product. The period of 14 days shall commence at the earliest upon receipt of the product and detailed instruction of the return policy in text form. Timely sending of the revocation or of the product is sufficient for compliance with the revocation period.

Products made to customer-specific requirements, products which are not suitable for return shipment due to their nature or software, audio or video recordings, insofar as the storage media supplied have been unsealed, are excluded from revocation according to statutory regulations.

 

2.3. Revocation consequences

In the event of an effective revocation, the goods/services delivered from both sides must be returned. If you can only return the delivered item (the product) to us partly or completely in a deteriorated condition, you must compensate us for the loss in value. This does not apply if the deterioration of the item can only be attributed to trying the item on - as would have been possible in a shop, for example. You can also avoid the obligation to compensate for loss of value by not using the item in its entirety and refraining from any action that might impair its value.

 

Goods that can be sent as a parcel should be returned as such. Items that cannot be sent as a parcel will be collected from you. Obligations to refund payments will normally be fulfilled within 30 days after sending your cancellation declaration. If you no longer have the original packaging, you must ensure suitable packaging to prevent transport damage.

 

2.4. You shall bear the costs for the return shipment, if the delivered goods correspond to the order and if the costs for the return shipment do not exceed the amount of 40.00 Euro, or if, in case of a higher price of the product at the time of the revocation, you have not yet provided consideration or paid an agreed partial payment. 3. Delivery

 

3.1. subtel GmbH delivers "while stocks last". If the ordered product is no longer available because subtel GmbH has not received the product from the supplier through no fault of its own, subtel GmbH may withdraw from the purchase agreement. In this case, subtel GmbH will inform the customer immediately and possibly propose the delivery of a comparable product. If no comparable product is available, or if the customer does not want an alternative product, subtel GmbH will refund any fees already paid.

 

3.2. If delivery fails despite three delivery attempts, subtel GmbH may withdraw from the purchase agreement. In this case, any payments already received will be refunded. You will be informed about the status of your order by e-mail in good time in case of undeliverable goods. If all items are in stock, the shipment usually leaves our premises within 2 working days, unless otherwise indicated in the offer. Orders which reach us by 2 p.m. on a working day and which to be delivered by express delivery will usually leave our premises on the same working day, provided all items are available. You will automatically receive an e-mail if certain items in your order are out of stock. If not all products from

an order are in stock, we are entitled to make partial deliveries at our expense.

 

3.3. Deliveries outside the European Union (EU), in particular to Switzerland, may incur additional customs charges.

 

4. Prices

The prices listed on the product pages include statutory VAT and other price components and exclude shipping costs and any additional costs for insured shipment.

 

5. Shipping costs

For delivery within the Netherlands, subtel GmbH will calculate the shipping costs detailed at the end of the ordering process per order.

 

6. Terms of payment

 

6.1. Payment is made by bank transfer, PayPal, Ideal or credit card. We reserve the right to exclude certain payment methods. If you pay by credit card, we will charge the credit card when the order is registered with us. The debited amount will appear on your statement after about 2-3 days. A right to compensation only exists if your counterclaim has been legally determined by court order or has been acknowledged in writing by subtel GmbH or has not been disputed. You may only exercise a right of retention if your claim results from the same contractual relationship.

 

6.2. Payment methods

 

Here are the procedures for our accepted payment methods. 

 

6.2.1. Pre-payment

 

You transfer the total amount to our bank account and we will ship your order immediately after receiving your payment. As a thank you for your trust, we give a 2% discount on the total order value.

 

6.2.2. PayPal

 

You pay the account amount directly to our PayPal account: paypal@subtel.nl.

If payment is received on working days before 2 pm, your order will be dispatched on the same day. In all other cases, your order will be dispatched on the next working day. Please note the availability status of the product in the online shop.

 

6.2.3. Credit card

 

You can pay conveniently with your VISA or MasterCard. In the event of complaints and returns, the refund will be credited to your credit card within 2 weeks. 

 

6.2.4. Cash on delivery

 

If you choose cash on delivery, you will pay for your order at the time of delivery.

You pay the purchase amount plus cash on delivery charges (9€) directly to the UPS driver at the time you take delivery of your order.

You must pay the amount in cash to the driver.

 

 7. Retention of title

The goods remain the property of subtel GmbH until paid for in full. Prior to the transfer of ownership, a pledge, transfer or modification of the item

without the consent of subtel GmbH is not permitted.

 

8. Transport damage

If goods are delivered with obvious transport damage, please complain to the delivery person as soon as possible and contact subtel GmbH, preferably by e-mail. Failure to make this complaint or contact will not affect your statutory warranty, but will enable subtel GmbH to recover damages from the transport company or transport insurance company.

 

9. Privacy policy

 

9.1. General

Your customer data is requested and stored exclusively for the processing of your order. The basic principles for this are the relevant privacy provisions in the German "Bundesdatenschutzgesetz" (BDSG) and the "Teledienstedatenschutzgesetz" (TDDSG).

 

9.2. Transfer of customer data

In order to process and deliver your order, we only pass on your data to the relevant transport company. This company may only use your data for delivery and not for other purposes.

 

9.3. Additional services

For additional services (customer account, newsletter) we require your consent based on the aforementioned laws. You can withdraw this consent at any time in our online shop, by e-mail or by telephone. If you wish, we will store your name and address in a customer database. After you have registered for these services, you will receive your customer number and password by e-mail as soon as possible. You can use this data to log in to our online shop on your next visit. After successful registration, your name and address data are already entered in the order form and do not have to be re-entered with every order. Sensitive data such as bank account or credit card numbers are not stored for security reasons. If you order the newsletter, you will be regularly informed about

news and offers. Unsubscribing from the newsletter is easily possible via an option directly in the newsletter.

10. Final provisions

If any provision in these General Terms and Conditions is ineffective, the agreement shall otherwise remain in force. Instead of the ineffective provision, the relevant statutory provisions shall then apply. The applicable law is German law, with the exception of UN purchase law. If the private end-user does not have a residential address within the European Union, then our branch office in Berlin is the jurisdiction. In dealings with end-users within the European Union, the law of the end-user's place of residence may also apply, insofar as consumer law provisions are expressly involved.
